Hi, my son was born outside of Uk but his father is a British citizen and currently residing in UK. He applied for divorce with previous partner for a year now and the process is still going on hence why I couldn’t apply for spouse visa. What do you suggest should be an ideal route to immigration for my child and i. Do we apply tor his citizenship first and my spouse visa later? Or do we apply family visa as dependents? What should be our first step for applying his uk passport and nationality? Please guide. Thank you so much!

If father is a British citizen and was so at son’s birth then son is a British citizen automatically. He doesn’t need to apply for citizenship. He can apply for a British passport or a CoE-ROA to enter the UK. Citizenship and passport are different things.

I presume from the tone of the question that the parents of the child are not currently married.

In which case,
(a) Is the father named on the birth certificate of the child?
(b) Crucially and very important, was the mother of the child legally married to somebody else at the time of birth?
