Child first passport rejected. Parent got ILR (before child was born) and becomed Bristish citizenship

Hi, I recently applied passport for my child and it was rejected. I wonder why it was rejected. My situation is that:

1. I got ILR early 2021
2. My child was born December 2021
3. I got my UK Citizenship in 2022
4. January 2024 I applied first passport for my child but it rejected. In the application I sent my child birth certificate as document. I'm not sure if it is sufficient, but I believe that is the only required document.

I received an generic email saying that "From the information available it would appear that xxx is not a British national"

From what I learned from https://www.gov.uk/check-british-citize ... 21-onwards I do'nt understand why it was rejected. does anyone know why?

If your parents were not British, Irish, EU or EEA citizens when you were born

You’re a British citizen automatically if when you were born at least one of your parents was living in the UK and had any of the following:

indefinite leave to remain (ILR)
right to re-admission
right of abode

You’re also a British citizen automatically if at least one of your parents was in the UK armed forces and you were born after 12 January 2010.

In the application I sent my child birth certificate as document. I'm not sure if it is sufficient, but I believe that is the only required document.
Did you send proof of your ILR BRP? That is mandatory as it is the ILR BRP, if the child was born in the UK after you got ILR, that determines if the child is automatically British. If the child was born abroad, the child is not British.

No I didn't send any proof of my ILR BRP as I don't have it any more. when I became uk citizen, I cut BRP half and sent it back.

I thought their system should have it by checking my current UK passport.

It is YOUR responsibility to submit the evidence to prove the child is British. It is not HMPO (separate to UKVI) to run around and find your documents.

Your UK Passport is irrelevant to the child's claim to citizenship. Their proof of being British is being born after you got ILR and you needing the BRP to prove it. A UK Passport it just a travel document.

Do you have a copy of the ILR BRP?

Thank you for the information. as I said above, I don't have BRP any more. Is there alternative way to proof that, rather than sending original ILR BRP?

Yes I have a copy (photo in my phone). doyou think that is ok?

It is YOUR responsibility to submit the evidence to prove the child is British. It is not HMPO (separate to UKVI) to run around and find your documents.

I think I found the same case here british-citizenship/applying-for-child- ... 19253.html they also mentioned that sending copy BRP also be rejected. there is no solution in that thread.

In the last post of the thread there was a suggestion to send HMPO the letter that approved the ILR.
Do you still have the letter (or email) that gave you the ILR approval?

Yes, I still have an email with my name in there and ref application saying that my ILR application was successful.

The problem is that my child passport application was just rejected. should I apply again with printed this email or somehow could I contact them to provide more document?

If your application was rejected and you received the documents back, I think you need to apply again and supply the ILR letter.

I suggest you contact the Passport Helpline - https://www.gov.uk/passport-advice-line

Ask to speak to a senior manager because the people answering the calls are not necessarily familiar with ILR and may fob you off.
Raise a complaint on their website - even if they say they'll look into it. You need to create a complaint record on their system.

I suspect you probably have to apply again because originally you didn't provide everything - though it's unfair that they didn't even give you a chance to explain yourself.

Thank you both. I will try to talk to them first to confirm that that email is good enough to prove my ILR and then I will apply again.

Do that, and call again (hoping you get to speak with a different manager) to see if you do get a consistent response to your enquiry even from senior managers.

Repeated message for on this forum for members to keep their ILR BRPs for situation like this.
Hoping the new system of showing status to be rolled out becomes advantageous for cases like OP's

A quick update my situation. They told me that approval email/letter or photo of ILR BRP will not be valid. I will need to submit a subject access request (SAR). Once I have that, I can provide as a proof my ILR BRP for the passport application. I believe this is a link to submit it. https://www.gov.uk/government/publicati ... mmigration
