SP50 speeding court conviction and naturalisation application

Dear all

I received my first ever speeding conviction on April 29th 2023 as I unfortunately drove at a speed of 68 mph through a variable speed limit camera with a limit of 40 mph. I got an SP 50 speeding fine of £660 and 6 points via single justice procedure of magistrate court and I was not asked to attend court so I paid by post. I have ILR with my family since June 2022 and we were all due to apply for naturalisation in June 2023.

This is my first ever conviction. I requested a DBS and it showed a clean record. The court letter mentioned that it is a non-recordable offence so it is not on the PNC.

I work as a doctor in the NHS.

My question to the esteemed members of the group, is it okay and safe for me to apply for naturalisation now (I will apply as main applicant with my wife and 8 years old daughter in the same application).

According to the guidance, one single driving offence is not likely to affect your application, but you have to disclose it in the application.

You won't be rejected for that offence but you will be rejected for not disclosing it. So make sure you mention that in the application form or in a cover letter, along with evidence that you have paid the fine.

Most SJPN offences are non-recordable and do not form a part of your criminal history. You didn't receive any non-custodial sentences as well.

The caseworker will consider "the balance of probabilities" based on all information they have had. As of the nature of your case, I can't see any reason they will refuse your application, as we have seen many people with more serious convictions were approved.

BTW, DBS checks are not helpful. You can only request basic DBS checks which only show unspent convictions and do not show your full criminal history or any other PNC records. You are not allowed to request advanced DBS checks.

Disclose the details of your fine in the application and elaborate in a cover letter. You will be OK.

Hi, I had similar situation (even more complicated then yours). I got ILR in Jan 2022. SJPN with £576 fine and 6 points in July 2022 for SP50. Then another 3 points and £100 fine for SP30 in April 2023. Applied for BC in Jan 2024 disclosing all of these details and got approval today. I didn't write any cover letter. I also disclosed 4 FPN (including parking and bus lane).

I was eligible to apply for BC by Jan 2023 (1 year after ILR) but due to these convictions I didn't. But decided to apply after update in "Good character" guidance in July 23.

One question please, in the application when asking about convictions and other penalties: do I choose the option: a penalty for a driving offence? although mine was not disqualification nor was it due to lack of motor insurance. or I choose 'No, I have never had any of theses' and then add my speeding offence separately?
