Hi there y’all,

My daughter has been born recently (25-3-2024) and my partner has ILR granted today (24-4-2024). Although my partner has done the application for settlement status before giving birth to the kid and somebody told me that the date of application is considered for giving citizenship to a kid that is born in uk.

I just want to ask if based on these given information my daughter has British citizenship or is the date that somebody acquires ILR a factor for deciding whether or not a baby gets automatically British citizenship so therefore my daughter has not a British citizenship?

If a parent holds ILR/EUSS status on the day their child is born that child will automatically be a British citizen and can apply for a passport.

The key date is the date ILR status is granted to the parent, not the date status was applied for.
What information were you given - what source?

Therefore, unfortunately, child is not British from birth.

She isn't a British citizen by birth but if you both hold ILR you can apply to register her as British with form MN1.
