Hello Gurus!

I'm after your advice for a 16 year old Naturalisation application. The case is slightly complicated, details below

Child born in India whilst the parent are in Work Permit, the child now holding ILR, however he is not stayed in UK for 5 years continuously, child stay in UK as follows

Jan 2008 - June 2008
Mar 2009 - Nov 2009
Nov 2010 - Dec 2010
Nov 2012 - Dec 2012
May 2022 - Present

Please could someone let me know if the child is eligible for Naturalisation if so could you let me know the application process?

You posted in the Ireland sub forum, which is incorrect for British citizenship queries.

The child can register as British once they have 2 years residence immediately preceding the application date AND is either parent is also applying for citizenship or is/are British and the other parent holds ILR.

The childs residence between 2008 and 2012 is irrelevant.

Note that only adults are Natualised. Children under 18 are Registered.

I'm after your advise here, CR001 kindly responded to my previous post but this been locked so I'm posting a follow up query here (original query in following link viewtopic.php?p=2124216#p2124216)

Here is the background of the case, child born outside of UK, at the time of birth both parent are Indian citizen. One of the parent is now British Citizen, child living in UK past 2 years with ILR status. Second parent is not intending to apply for Naturalization, here are my questions

1. Can a child apply to register for Naturalization without their parent
2. MN1 is correct form to complete, if not which form
3. If filling in MN1, what should I complete for question "1.1 Indicate the section of the British Nationality Act 1981 under which you would like the application considered"

The closest option for your case, as far as I can see, is in section 6.5 here https://www.gov.uk/government/publicati ... section-31 , which requires 5 years of residence for the child.
But other moderators may be more aware of other options than me.

Hi CR001, Is the requirements to have "2 years residence" or "2 years residence holding ILR" ? I thought its te former.

Another unrelated question. While searching through this forum, I see people mailing FNE. Pardon my ignorance but can you help understand what is FNE? I dont get useful answers while searching online

A minimum of 2 years residence and they need to hold ilr.

FNE is further nationality enquiries but is not a general enquiry contact point for general queries.

Thanks CR001. So it is "2 years of residence" and need to hold ILR at the time of application ( the time for which ILR is held does not have to be 2 years.

Please could someone shed some light here, we made an application for MN1, we posted the documents to below address however I'm getting mixed messages that we should only apply online if the child is in UK?

Correct link.

Yes, if and the child is in the uk, you must apply and pay online and book a ukcvas appointment and upload documents digitally.

If you have already applied using the paper form (which clearly says for those outside the uk) and posted documents, it is too late now to change.

Why would they return them?

If you posted the paper form and the documents, you are on the postal route, which takes a lot longer. Documents are only sent back once the application is processed and approved.

Someone said they'll return it. Its ok if the process takes longer than usual, we shall wait to hear back from them

Yes, but only once approved/refused and processed. So you have no identity documents or proof of status till then.

It takes about 2 months for the payment to be processed also based on what a small number of others have posted. Processing starts once payment is processed and biometrics enrolled.
