My husband has had ILR for 10 years and married to a British citizen. We want to apply for British citizenship. He has been in the Uk since 2012 and is married to a British person and has 2 kids who are British. He came on a visa legally as a spouse and not had any bad immigration history and worked legally. No bad debt or prison or criminal history. Only thing was 6 points on driving in 2023. Will his application be refused. Also from English speaking country and passed life in the Uk test. Only left the Uk for short holidays
Would he be refused citizenship based on this
The offence was in December 2023 and a fine was paid in June 2024 with a 6 point endorsement
Thanks in Advance

If that is the only offence, and it didn't lead to serious harm, no. He does need to declare it in his application.

If the 6 points came via 2 FPNs then you do need to check its not withing the last 12 months period but FPN do need to be declared. Also above dates shows its taken 6 months to Pay, was the fine paid in court ?

Some fines take a long time to be sent and received.

The fine took about 5 months to come. He plead guilty and was given a fine and points. Now we don't want to waste money if we apply now but would like to apply for citizenship

If that is the only fine or issue with the law you ever had, disclose it and apply. It will be fine.

Thank you
Could I also ask would I need to answer yes on this question?
The points and fine were issued via an online magistrate
A criminal conviction
2. A penalty for a driving offence for example disqualification for speeding or no motor insurance
3. An arrest or charge for which you are currently awaiting trial
4. A caution,warning, reprimand or other out-of-court penalty
5. A civil penalty issued under UK immigration
6. No I have never had any of these offences

you need to answer Yes because you have a driving offence.
