Good afternoon,
In Jan 2025 I should be ok to apply via 5 years ILR route all my absences are below limit by a huge margin
is it ok if I apply via ILR, 5 YEAR route ,
note that I'm married to British citizenship and I have made previous applications via the 3-year route but was just refused in Dec 2024 because of absence, in last year exceeded limit

Best Regards

If you have ILR (irrespective of visa route) you can apply, subject of course to meeting the requirements, as you found out already.
On the refusal was there any advice when you could apply again?

Your question and information is very unclear.

Do you have ILR or not? You can only apply for naturalisation if you have ILR or Settled Status.

With regards to absences, note that ILR and naturalisation are two different applications, with different requirements, rules and laws. The absences requirement for ILR and naturalisation are different. Do you meet the absences requirement for ILR? Do you meet the absences requirement for both three years and one year for naturalisation.

@secret.simon... I've ILR already ....then applied for Citzeship via 3 years route but didn't work out well :D due to my absence in last year , now in Jan 2025 - if I apply via 5 year route instead all my absence are within the limit 100%

My question was ....I'm I ok to apply via 5 years route or I have to stick via 3 year route (as I'm married to British citizen)

You can choose whichever route you want, just don't select you are married to a British citizen and/or declare in a cover letter you are applying under Section 6(1). Note that the future intentions requirement will apply to you therefore you need to make sure you don't have immediate plans to leave long term and apply for your first UK passport in the UK.
