Citizenship after ILR

Hello,

My spouse has just received ILR application via Set(M) 5 years on spouse route.

I want to check if we can apply for the British Citizenship straightaway?
I assume we dont have to wait 1 year.

Are you a British citizen?

If you are, then yes, they can apply immediately, provided they meet the 3 years physical presence and absences requirements.

Thanks yes I am British Citizen.

What is the three year law? Is it just applicant need to be in the country 3 years ago?
Is it 3 or 5 years?

If the applicant is married to a British citizen, they need to

(a) have absences of less than 270 days in the three years immediately preceding the date of application, AND,
(b) be physically present in the UK at the start of the three years period referenced in (a) above.

So for instance, if your spouse were to apply today, they would need to have been in the UK on 5th February 2022.

Other requirements (such as English language and LITUK, etc) also apply.
