Registering 2 Year Old as British Citzen

Hello Gurus,

I would appreciate your response on the question below:

I have 3 kids(2 from 1st wife and 3rd from second wife)
1st Kid(6years old) : ILE (After divorce got the sole custody) Born in UK
2nd Kid(5 years old): ILE(After divorce got the sole custody) Born in India
3rd Kid(2years old) : Visa expiring on 21July 2025, Born in India
Second wife visa also expiring on 21 July 2025.

I am a British Passport holder and in receipt of PIP(Higher Disability Rate). I would be soon registering Kid 1 and 2 as a British Citizen. My question is CAN I REGISTER MY 3RD KIDS AS A BRITISH CITIZEN ALONG WITH FIRST 2.

PS: Also to bring to your kind notice that once i took the British Nationality, Indian High Commission has refused to renew the Passport of my Children stating the If either parent renounce the Indian Passport the Kids are not eligible for Indian Passport and are not Indian anymore. This make all my 3 kids STATELESS as i cant get an Indian passport for them from Indian High Commission.

Please advise me what would be the best option me to register my Kids as British Citizen.

Your 3rd kid needs ILR before becoming eligible to apply for citizenship. Note that being stateless is NOT the same as not having a passport. Are you absolutely sure your kids nationality has been revoked, or is it just the case that they won't issue your child with a passport? The two things are fundamentally different.

Kindly note that if any person (either FATHER OR MOTHER)has ceased to be a citizen of India under sub-section (1) of Section 8 of the Citizenship Act, 1955 due to renouncement of Indian citizenship, every minor child of that person shall cease to be a citizen of India under sub- section (2) of Section 8 of the Citizenship Act, 1955. However, such child may, within one year after attaining full age, make a declaration in the prescribed form and manner that he/ she wishes to resume Indian citizenship.

High Commission of India(London) has refused the renewal of the passport of my minor child stating above reason. Thats make my child neither the citizen of Indian nor the citizen of United Kingdom. It does mention the my child can resume Indian citizenship one year after attaining full age(19 years), my child is just 2 years old at the moment.

Thats leaves me with no option and a difficult situation.

That is noted. However, the guidance specifies that it ONLY applies to children that have ALWAYS been stateless. Your children's Indian citizenships have revoked (I assume) AFTER they were born (and child 2 and 3 were born in India) so this provision does not apply to you unfortunately. My advice above remains valid, 3rd kid needs to obtain ILR before being eligible to apply.
