Obtain Citizenship with ILR issued in 2005

Dear colleagues,

Here is the situation. I took the ILR in 2005 and since then maintaining the immigration status as ILR. My son (25 years and single) was on and off between UK and India due to his studies. He did his Masters here in UK after completing his Higher school and Bachelor's in India. Currently working in India since 2023 and visited us in 2024. so technically ILR is active. He is now looking at taking up British Citizenship.

GOV.UK site says one can be eligible for Citizenship, with an active ILR and lived in the UK for 5 yrs and have had one of the following in the last 12 months i.e. ILR or ILE. Moreover at the time of applying for the Citizenship one cannot be out of country for more than 90 days in the last 12 months.

Question : Since, he has an active ILR can he be eligible for British citizenship provided he fulfills the last 12 months active stay in UK or he has to also fulfill the condition that says in the last 5 yrs no more than 450 days should be out of UK? Request your steer.

He has to meet all the requirements.

5 years legal stay with no more than 450 days absence.

At least 12 months on ILR with no more than 90 days absence in the 12 months immediately prior to application date.

He also must have been physically present in the uk at the start of rhe 5 year qualifying period.

Also note your own ILR is not relevant to this scenario. Your son is an adult and has to satisfy all requirements in his own right.
