Hello Dear Members.
My family received ILR this morning and I have a situation for that I am seeking some advises.
In my previous posts about the ILR for my family the timeline is mentioned so just for ease of matter they are mentioned again.
Wife with 3 Dependant Children (2 Adults now + 1 Minor)

Arrived in the UK 23-11-2025
Applied for ILR 28-10-2025
ILR Granted 03-11-2025

1.Now the question is that can we apply for their naturalisation now or do we need to wait till 23-11-2025 this is when their 5 year qualifying period will complete and then apply?
2. I know all the adults will need to apply on form AN1. So can the minor child be included in the Mother's application? or do we need to apply seperately for him using MN1 form? And also if MN1 form then can we apply straight away now?
3. Does the 28 days concession apply to this application as well? (I doubt as this is not immigration application)

Your help is much appreciated and I look forward to your valuable comments.

1. If you are British, then your wife and younger child can apply now assuming your wife meets the 3 year requirments.

2. Your adult children have to wait till rhey have held ilr for 12 months. Your younger child can be added to your spouse's application.

4. There is no 28 days concession for citizenship. It is not an immigration application.

All my children were under 18 when they initially got their dependant visa (My Wife's Dependants) and hence they got the ILRs together.
So will they have to wait 12 months?
Can you please guide me to this 3 years rule? If so I am ready to apply for at least my wife and the minor child.
Can you please also advise if we can travel abroad after the biometrics submission while this application is under consideration. I believe we should be able to as this is not an immigration application. What are your thoughts

Your older children are over 18 and have to meet the adult requirements, which includes holding ILR for 12 months. How old they were when they came to the UK is completely irrelevant. They are adults now.

Your spouse must meet the 3 year residence and absence requirements if you are British, including the physically present at the start of the 3 year period. This is all detail in the guidance notes.

Completely got your point. BUt what I was trying to say is that they were on family of a british citizen route so do they still need to spend 12 months on ILR. Coz what I knew and heard that family members do not need to wait for 12 months after getting ILR to apply for naturalisation.
What you are saying that their route through which they got their ILR is irrelavant for naturalisation?

They are treated as adults once they turn 18 and their route to ILR doesn't given any advantage. They have to wait 12 me the like all other adults who are not married to British citizens.

For citizenship, there is also no concept of "family applications". Each applicantust meet the requirmenta individually.

It is only your spouse and child under 18 that do not have to wait 12 months.

Also please advise if my wife need to complete full 60 months before she apply for naturalisation or is this last 3 years period which is considered?

She adds rhe child in her form where the option comes up. The form will adjust for the child.

No, her application is based on 3 years, counting backwards from the date she applies.

Your adult children will need to sit for the Life in the UK test and the English language test too.

They have got them already as part of their ILR application.

Then they will be able to reuse them.

Although your questions have been answered above, it may help you to understand why your adult children can't apply as your dependents any more.

Once the person has ILR, they are no longer dependent on their sponsor, whether spouse or parent (or child in some cases), for their immigration status. Their status is now independent of their sponsor.

Secondly, the immigration pathway ends at ILR. Acquisition of British citizenship is not a part of the immigration process and is not connected to it. There is no timeframe for applying for British citizenship. Some people apply as soon as they are eligible, some apply years later and some live their entire lives in the UK on ILR status.

Therefore your adult children are (a) independent of you for their immigration status and (b) need to meet the naturalisation criteria in their own right, on the same basis as you (an adult). From the viewpoint of the law, they are adults over 18 and have an immigration status of their own, not dependent on anybody.
