What is the status of a child born in the UK in 2005 of a parent who, at the time of the child's birth did not have indefinite leave to remain? I know that they won't automatically be entitled to British Citizenship and that the parent can apply on their behalf at the time that the parent with ILR is naturalised. Pending the parent qualifying for naturalisation what is the child's status in the UK?

Is this still the case if the parent with ILR is the father and the parents were not married at the time of the child's birth? The guidance seems to suggest that a father with ILR can only apply on behalf of the child if he was married to the child's mother at the time of the birth.

If father is unmarried, registration will be done under section 3(1).
If parents subsequently married, registration can normally be done under section 1(3).
Either way, age limit of 18.
