Child's British Passport query-post JR

Dear all,
Our baby was born in Jan 2009 and subsequent to the JR ruling(4-5yrs) reversal we got a pre-dated ILR valid from Oct 2008. By that time we had already secured a Indian passport for the child. Subsequent to the JR ruling we sent all 3 passports and got ILR stamps unknowing that the child was technically a British citizen already because our ILR validity was back-dated.
The query is :
a) Can we still apply for a British passport for him ?
b) Is the straight to passport route preferrable to the MN1 route for him ?
