I wonder if someone else might help me in this circumstances, i am british by naturalisation this month,10/05/2010, married to my french wife wife for nearly 8years now, but unfortunately she couldn't have a baby, so saw a lady impregnate her and she had a beautiful girl last year march. Although myself and my french wife have now divorced and i have promise to be there for my daughter born out of wedlock and i have got my name on the birth certificate.

The question is can i apply for passport for my daughter straight away. i will be happy if anyone over thre can help me

i have red your post, it means i will apply with form MN1 and apply for british passport it's that right?

If your child was born after you had attained Permanent residence/ILR, then child is already British and a MN1 application is not required.

If the mother of the child is already married to someone else, then child may not be British.

The child mother had not married before in her life, she is my girlfriend, the pregnancy came unplanned.

I got my permanent residence in 2008,that was before i gave birth to my daughter

What does this mean? IVF? Surrogate?

it's not surrogate or ivf. i cheated on my wife before we divorced. that was the main reason we divorced because i pregnate another woman without her knowing and my baby mother and myself are living together now.

Was the child born when you were still married to your wife or after the divorce? Was the child born in UK? Who is (are) named as parent(s) on the child's birth certificate?

The child was born while i was still married to my wife and the child was born in U.K. I was named on the birth certificate as being the father of my daughter.

Is the child's mother British?

The child mother was an overstayer. she's not british, she's a Ghanian.

Yes, she's still an overstayer.

As long as your name is on the birth certificate and you had ILR when your daughter was born she is already a British citizen.

Ways to prove it are a British passport and/or a certificate of nationality status.

It was not ILR that i was issued with then, it was permanent residence, because permanent residence is attain automatically after 5 years of your wife(eu national) exercise treaty. Thanks, guessed both are the same.

Are they the same? Big assumption to make.....
