Family eligibility

Hi,
I am living in the UK with an Indefinite Leave to remain here.
I have initially arrived in this country on 17th June 2005 and thus qualify for naturalisation on 16th June 2010 in line with the current naturalisation rules.

My wife joined me in the UK on 17th September 2005 (as my dependent) and was granted Indefinite Leave to remain on 4th July 2009 along with me and our son who was born on 4th July 2006.

We three would like to make an application for naturalisation on 18th June 2010.
Today I was thoroughly reading the guidelines and am bit concerned about my wife’s eligibility, as she is intending to submit her naturalisation application along with me on 18th June 2010 as she has been in this country as my dependent. Will she be eligible to make a naturalisation application along with me or is she expected to complete 5 years from the date she arrived here.

We entered this country on the old HSMP visas.

I don't think you can apply until 4th July 2010. As you can't apply for British Citizenship until you have had ILR for 1 year.

Until you get British citizenship (actually attended the ceremony) your wife cannot apply until she has been in the country for 5 years and had ILR for 1 year which I believe would be 17th September 2010. Once you get British citizenship your wife only needs to have been in the country for 3 years and had ILR for a day.

So either you wait until both of you meet the criteria or you apply separately.
