I got my ILR in July 2009. Both myself and my wife have completed 5 years of stay in UK and are planning to submit our applications as a joint one. My son was born in Sep 2008 (in India, came to UK in Dec 2008) and would have completed only 2 years of stay in UK by the time of application.

My query is this - is there a minimum time period before he can apply. The guidance says something about a 3 year time period. Can he apply at the same time as us ?

He was born in India, he came to Uk in Dec 2008

As son is under 13, no residence requirement as long as child has ILR, is living in Britain, both parents have ILR, and at least one parent is British or becoming British.
