CAN I APPLY FOR BC

Post by yusfaith » Wed Oct 06, 2010 7:12 pm

I came to UK IN 2002 and married to my ex-EEA in 2004. I applied for RC then in 2004 but was not granted not untill 2006 for one reason or the other. After 5 years of our marriage, we divorced in 2009. In 2010, I applied for my PR confirmation and was granted in August. My question is can I apply for BC now or I have to wait till 2011.

I guess I can since I have acquired my PR status automatically at the 5 years of our marriage which was 2009 and we only divorced after that. Though, the confirmation was issued in August 2010 as in sticker in my passport.

Obie and john, your contribution will be appreciated also guys.

I think it comes down to this. Can you prove that you automatically got PR status on the 5th anniversary? If the answer to that is yes, then apply now, otherwise wait until you have had confirmation of PR status for one year.

Thanks John, Yes I can prove that by providing all the document used in applying for my PR like p60 for my ex through out this period of 5 years.

I called HO today and was told a decision had been made for naturalization and it has been sent to me by 2nd class post. Does anyone know how long it takes to receive this.

Thanks Rani, I only sent my document. not even p60, I sent a statement of my tax/NI contribution from April 2005 to April 2010 with a covering note explaining how I acqired my PR Automatically at the 5 years anniversary of our marriage.

However, in your own case, you got married in March 2005, you automatically acqired your PR status in March 2010 and you can only apply for BC anytime from March 2011.

You can call HM Revenue and ask them to send you the statement. This is is short note I included:

I married to me ex-wife (eea national) in February 2004 and we both have been exercising our treaty right since then as an EEA national and family member. In 2006, my initial 5 years residence was granted by the Home Office.

In accordance to the new EEA immigration regulation that came to effect since 30th of April, 2006.(Ref to page 5 of naturalisation guide). We both automatically acquired our permanent residence in February 2009 being an EEA national and family member who have been exercising the treaty right for a continuous period of 5 years from 2004.

From February 2009 when I automatically acquired my permanent residence to February 2010, I have held the permanent residence status for another 1 year to make it 6 years which qualify me for naturalisation.

However, I divorced my ex-wife in September, 2009 and in March 2010, I applied to the Home Office to confirm my permanent residence status to have the sticker on my passport as a proof and confirmation which was approved.

I wish my application would be given a favourably consideration and it would be a great honour for me to be a British citizen

Does anyone knows how long it takes to get an interview date for british passport. Do I have to call to book for appointment or need to wait till I receive a letter from them.

whats the poin using check and send at post office?
when I was sending application for my daughter passport(she is BC because of my PR before she was born) they ask me if I want use it, I said yes.then woman looked at all paperwork and ask how do I want get BP if I`m not BC. I explained to her, them she said she can`t check it because it is too complicated, and she send it by recorded delivery.
so what for they charge if they have`t got clue whats going on?
