My story goes thus:
1) My wife is an EEA national ( Hungarian )
2) I'm a non-eea spouse of an EEA national ( Nigerian )
3) My wife came to the U.K in september 2005 and she has been working since then till date.
4)I came to the U.K in december, 2006 on EEA family permit
5)We applied for registration certificate and residence card in june 2007 and was issued in sept. 2007. and will expire in sept.2012.

My question is this: Our first baby is due to be born at the end of april 2011 and we want to apply for british passport for the baby after birth.
I would like to know if the baby qualifies for british passport automatically by the due date, due to my wife's length of residence in U.K.?
She does not have confirmation of permanent residence but she has been living and working in U.K since 2005 september and has p60's since arriving in U.K till date ( p60's for year 2006,2007,2008,2009,2010 till date ).
Will the baby qualify?

to make thinks easy apply for her PR, then after baby was born you will get minor`s British passport under BNA section 1(1).
baby must be born in the UK to qualify without registration.

@boloney...... thanks a lot for your reply. The baby will be born in U.K but is it compulsory that my wife must apply for the confirmation of her permanent residence before british passport can be obtained for the baby?
Based on the years she has spent in the U.K exercising treaty rights, i think p60's will be ok to prove those years and perhaps a letter from Jobcentreplus stating that no benefit was received before the child was born. Hungary accepts dual citizenship

will jobcentre plus give you letter stating that she did`t claim benefits?
my mate ask them and they refuse give him any letter, they said that he isn`t in the system as a claimant.
if she apply for PR that will save her any problems.
that`s your choice, I have PR card and they issue the passport for my daughter in week, I was surprised that was done so quick.

If mother doesn't get confirmation of PR before child's birth, then child may apply for Confirmation of British nationality status.

@ boloney and vinny..........please read petra stories........i think with only p60's covering the last 5 years ( without confirmation of permanent residence ), the baby will get british passport automatically.

Neither confirmations of status are necessary, but they may make obtaining a British passport easier.

Thanks vinny....... i just phoned IPS ( identity and passport service ) and was told that p60's covering the whole of 5 years, the baby's birth certificate and my wife's(hungarian) passport ( without confirmation of permanent residence ) are ok and the baby will be issued a british passport automatically.

did they mention confirmation from jobcentre plus or department of work and pensions about claiming benefits?
my mate applied with his tax calculations and they ask him about confirmation that he did`t claim benefits.
jobcentre refuse to give him one, IPS keep sending him letter that they can`t issue the passport without the letter stating above.

@ boloney....the IPS did not mention any other document. They only need documents I've mentioned earlier. Your mate should seek legal action against that. Thanks

@boloney......legal practitioner should take up the matter or MP where your mate resides. His case will be sorted out straightaway

IPS ask for bank statements covering 5 years, after they send statements IPS issued passport for kid.
passport passed to print

@ boloney....when did they ask for bank statements? Have they forwarded the bank statements? Has the passport been issued?
