Hi,

First of all let me thank this forum for being helpful & useful as always has been. Special thanks to my friend Sushdmehta for the help during ILR last year who was in a similar situation as me.

I am due for citizenship now and seeking advice on below:

I entered UK in Jan-2005 on WP.
My Wife entered UK as my WP dependant in Feb-2005.

I switched to my own HSMP in Feb-2007. (I got initial approval in Nov-2006. i.e. based on the rules prior to Nov-2006 But later than Apr-2006). Got further 3 Year Extension in Feb-2009.

Meanwhile my wife switched to her own HSMP in Dec-2006. (My wife got her HSMP initial approval in Sep-2006. i.e. based on the rules prior to Nov-2006 But later than Apr-2006). Then she had a further 3 year extension after applying HSMP extension in Dec-2008.
She continued on her own HSMP until Feb 2010. In Feb 2010 she switched back as my HSMP dependent so that she could apply for ILR with me.

Our UK born baby (mid-2007) was on my HSMP dependant Visa and now on ILR like us since Feb-2010.

We all together applied for ILR (myself as main applicant and wife & baby as my dependant) in Feb-2010 and received it successfully.
Also, we have received a supporting letter indicating that the ILR can be counted from Jan-2010 (i.e. backdated. although the stamp indicates Feb-2010.

We are hoping to apply towards the process of British Citizenship this month asap.

Queries:

1. What’s the best & reasonable way to get our Citizenship together?
[Please can you specify all possible options / routes, Thanks]

Wish you all a very Prosperous & peaceful New Year.

Thanks as always.

Welcome back!

Your spouse may apply for naturalisation through either of the following routes:
Route 1 - Complete 5 years in the UK and upon fulfilling standard requirements apply for naturalisation.
Route 2 - After you are granted British citizenship (naturalisation certificate), your spouse may then apply for naturalisation as spouse of British citizen as and when requirements for spouse /civil partners are met.

If you wish to apply for naturalisation together, both you and your spouse will need to fulfil the standard requirements (Feb. 2011?).

You may make an application for registration as British citizen under section 1(3) for your UK-born-child anytime - along with the (individual / joint) naturalisation application or even separately (e.g. - today).

If your spouse fulfils the standard requirements in Feb.'11 or in the near future, wait until then to make a joint application. Economical option!

Hey... glad to see your reply.

I think we all 3 will wait until Feb end and will apply together.

Thanks!

Hi Deal99,

Though away from the point, but for the benefit of other members, it seems that the 2 year requirement for Tier1 dependants didn't apply in your case as your wife got ILR in Feb 2010 without being your dependant for 2 years in the UK. Was it because it was your HSMP was pre Nov 2006?

Hi Sush - as specified above, she entered UK in Feb-2005. In that case, I think we can apply *together* anytime after the “dateâ€

Who can we use as refree for our 3.5yr old child?

GP seems to have dropped from the list?

Child goes to Nursery (registrd) but not sure if the Nursery care-taker/teacher(?) would be OK ?

Nursery teacher should be ok. Our nursery teacher signed as a professional referee on our kids forms.

Thanks to this forum again!!

We applied under family application and have received positive results.
Awaiting oath.
(We provided the reference of Nursery manager - she provided PP no. Rest of the references were from friends who are IT consultants.)

I have further questions:
- What would be our status if after receiving Naturalisation certificate (i.e. post Oath), we don't apply for British PP? Are we then still Indian National (our current PP & Nationality is Indian) ?

After the ceremony you will receive naturalisation/registration certificate which will state that you are all British citizens. Applying passport has nothing to do with your British citizenship. Once you are done with ceremony and received the certificates, the dates mentioned in the certificates are the dates you are all respectively become British citizens. Kids registration certificates may be the same the date they are granted the citizenship by HO. You and your wife naturalisation certificates will have the date you take the oath ceremony.

You cannot use the Indian passport after the dates in the certificates. If you do then you will have to pay the penalty.
