Hi,
I came to the UK on 10/12/2005 on my HSMP to look for a job(successfull!), returned to India in Jan - till March 2006 (3 months) to complete by notice period. Came back to UK and joined my new employer from April 2006.

I received my ILR in Mar 2010, but also received a letter from home office clarifying that I am deemed free from immigration restrictions from 10/12/2005.
Also, the PEO lady confirmed that I will be able to apply for my naturalisation in Dec 2010.
I have not stayed more than 450 days outside the UK during this 5 year period(even if you include the 90 days from Jan-Mar 2006) and NOT more than 90 days in the last 12 months.

However, I was not in the UK 'physically' during Jan,Feb,Mar 2006.
Does this mean I will be able to apply for my naturalisation only in April 2011, as I was physically present in the UK in Dec 2005 and then from April 2006? Request some experts to confirm?

Thanks in advance.

Cheers
M

Thanks Wunder. But how will they know, because as per the letter from home office I received with ILR my the date on my deemed immigration restrictions were lifted on 10/12/2005.

Indeed so, and also the entries on the form AN .... dates out the UK .... which of course will have been completed correctly!
