Discretion exercised by HO on UK absences?

Has anyone had discretion exercised by the HO to disregard absences of over 270/90 days on applications submitted as the spouse of a BC?
I am over the limit but travelled abroad with with my husband on numerous occasions as he works overseas for more than 6 months of the year.
