British Citizenship after 12 months of ILR

Hi

I got my ILR in Oct 2010 and my BC is due in Sep 2011, I have already spent 90 days visiting out side the UK, I am a self employed contractor, now i have been offered a contract outside the UK for 6 months, Now i am confused that should i get my BC in 5 months or get the contract make some money and apply the BC later. If if take the contract would i be able to apply for the BC straight away on my return to the UK ? or i have to wait for another 12 months before i can apply for the BC?

Any advise will be much appreciated. Many thanks

You would have to wait a further 12 months...with no more than 90 days in that 12 months spent outside of the UK.

If the money is good and you can deal with the delay in getting the citizenship, then fine.
The "problem" is if after 6 months abroad they want to extend your contract, then you may find on a situation where the british citizenship is further delayed or you even may lose your ILR if you stay abroad on a permanent basis.

Many thanks for you replies, i was under the impression that any Days spent outside the UK on business trip are exempt and if i can demonstrate that most of my state is in the UK i.e. the connection to the UK, it should be okay ?

You are correct, your days out of the country on business can be disregarded if the HO use discretion when you apply.

I have more than 90 days out of UK in my final year, but all to accompany my BC husband on business trips. I will let you know how my application goes as I only submitted on 12th April through NCS :D

NCS (Nationality Checking Service) is provided by most local councils to check and submit your application for BC. Just go on line and you'll get all the information.
The benefit of using NCS is that they photocopy all your docs so you get your passport back on the day. It comes at a price as it cost me £55 but well worth it because me & hubby got our passports back the same day! :)

Atif be careful, what is the guarantee that Government wont put a new hurdle in the path of citizenship in future ( earn citizenship etc )? Laws are changing and becoming tougher every day .

Hi

I was looking at the UKBA website and found this

Absences during the final year

If you have been absent from the UK for up to 100 days in total during the final year, we normally disregard the absence.

If you have been absent from the UK for between 101 and 180 days in total during the final year, we normally disregard the absence if:

-you have met the residence requirements over the qualifying period; and

-you have demonstrated a link with the UK by establishing your home, family and a large part of your estate here.

So looking at this i can only accept the contract for 3 month only ? I do have the strong connection to the UK i.e. large part of my state is in the UK

Anyone, anyone at all? Clearly the answer is yes, given that for those married to (or in Civil Partnership with) a British Citizen, the 12-month condition does not apply. But of course there are other conditions.

From when you applied for your ILR until it was granted, was it more than 3 months? If yes, and the delay was not your fault, then you might be able to apply for Naturalisation from 15 months after you applied for your ILR.

But of course other conditions to pass as well.

Thanks for the reply John, I applied for the ILR in Oct 2010 and it was the same day appointment and i got it in one day. The ILR was granted on the basis of Work Permit 5 year rule. But i was on student visa before WP, in total i have been living in the UK for 10 yrs in July. Please advise

So as "issued the same day" is noticeably less than the 3 months I mentioned, clearly there is no "let out clause" for you.

You must hold your ILR for at least one year before applying for Naturalisation.

I have received ILR after 10 years long residence. The date of issue of ILR is 01 Feb 2013 and expiry date if ILR is 01 July 2022, 10 years from the date when I applied for ILR.

Can anyone tell me what date I would become eligible to apply for citizenship.

Not sure why you have posted into a two year old topic, but as regards the date 01 July 2022, is that actually the date of expiry of your current passport?

ILR with an expiry? I thought it meant 'indefinite leave'
ILR in itself does not have any expiry, it's the biometric card that comes with a expiry. You just got to renew it after 10 years like you renew your passport, bank cards or driving licence

I agree and that is what confused me when OP specifically said that his ILR will expire on '01 July 2022'.
