Advice Please!

awkward situation

I requested for return of passport from HO for travel purpose.They kept only Life in th UK certificate and sent bak everything what i received back:

>The whole application form(surprised to see this)
>My Passport and BP.
>ESol cert
>supporting docs.
in other words they have sent back everything apart from life in the UK certificate.

in the letter caseworker saying you have not met one of the requirement i.e i was supposed to be physically present in the UK exactly on the date 5 years before the date of application.(i was on holidays).

Confusion is,they have not refused the application and said if you want us to continue considering your application send us back same application form back but extra 99 pounds(new fee applies now )and i will have to do the Bio metrics now and we will continue considering application.if i do not send them form back by 20th Oct they said we will refuse your application.

So do you guys think is it fine to send application back and 99 extra or no point because i donot think they will approve my application as i do not meet one of the residential requirements(unlucky me,,i didnt know about this rule when applied).but again i do not know whether caseworker has power to use discretion in this kind of case or not.

but i think chance of my approval are very slim. :D
i do not have any clue what to do .

Please guide if someone can.

I believe that your case is approved they only asked you to send the money and do the biometric as they are considering your application from the date you send them now. I think you should send them £99 and form. Hope all goes well.

I believe that your case is approved they only asked you to send the money and do the biometric as they are considering your application from the date you send them now. I think you should send them £99 and form. Hope all goes well.

This is exactly what i am thinking because the case worker mentoned in the letter that to avoid any "futher problems' send your form back by 30 oct.
You are right now if send the form back with 99 extra and do the biometrics and post it back,the date HO will receive (sometime in oct) the application, will become date of application.in this way 5year ago ,oct 2010 i was physical present in the uk which will save me from being refused on the bases of not meeting the residential requirements.

Anyways, sending the form back now with 99 extra and resigning the biometric section of the form again.
Hope all goes according to what i am thinking :).

I have called Home Office today and adviser said they do not have access to the data base and they cannot tell me the application status. Only the thing they can provide some advice (general). I am starting to wonder whether there is any correlation between those that have IELTS versus ESOL and the approvals. Maybe those that have ESOL will have difficulties when the policy changes in November and I would be one of them. Please let me have your thoughts and maybe we could get the English exam type added to the spreadsheet.

My wife applied on 28th April 2015 but still waiting.
