HI Guys,

First of all this site has been very helpful.

I need some advice please -

I am a non-eu national, family member of EEA national.

Got married - 3/09/05
Applied for PR - 10/09/10
Date on Pr stamp - 26/01/11
Divorce finalized - 15/07/11

Question 1 -
Can i apply for BC on the 03/09/11 ?

Question 2 -
Do i need my wife's p60's etc to apply for BC or can i apply with my p60's etc ?

Yes, assuming you meet the standard requirements. Although it would be easier to apply 1 year after your PR sticker date to save you proving again that you have exercised treaty rights from Sep 2005 until Sep 2010. You will still need to provide evidence of residency during that period.
Do i need my wife's p60's etc to apply for BC or can i apply with my p60's etc ?
Once you have obtained PR (automatically), you are applying by your own rights. No need for supporting documents from your wife.

Thanks for the info.

Whats the difference between applying before and after the PR stamp - documents wise ? do i not have to prove my residency ( bank statement, p60's etc ? ) if i apply after the PR date stamp ?

You still need to prove your residency (in the 5 year prior to the application). This can be in form of stamps in your passport (in case it was stamped even though you are EU family member) or tenancy agreements or letters from employers.
You don't need to prove you were economically active with the PR (so no need for P60).
