Documentation to prove sole custody of children

Hello everyone,

I'm a British citizen.I've made an application MN1 for my two childrento be registered as British citizens under sec 3(1)(they both have ILR). I'm divorced and have sole responsibility of the children since 2009. My ex-wife has no permit of stay and we seldom from her.

I received a letter from the Home Office yesterday requesting for the following information before the application could be considered.

i) The passport or Home Office letter in which indefinite leave to remain in or indefinite leave to enter the UK was granted to my ex-wife.

ii) Documentation to prove that i have the sole custody of both children.

I made the application as a sole parent and my ex-wife only sent a letter of consent to support it, stating i've the sole responsibility of the children. I provided divorce certificate, school letters etc.

Since i don't have legal document of sole custody of the children, What documents can i send to prove this??? Also my ex-wife hasn't got a stay in the Uk. Can it affect the children's application? What can do???

Did the court not decide on custody of the child at the time of divorce?

No, the custody of the children at the time of divorce was done on a mutual consent between my ex-wife and myself.
