BC after 1 year of EEA4 and seperation with eea spouse

Post by zinger1 » Fri Nov 04, 2011 5:08 am

hello everyone , i received my PR after the eea4 application in october 2010, i have lived separately from my wife since December 2010. We have a son, who we look after collectively. we only live separately not divorced.

on the AN application there is no tick box for seperated so which box should i select. And do i again need to provide evidence of my wife exercising her treaty rights.

If you are legally separated tick that box. If not, then you are still married.
If you got a PR sticker, then you don't need to provide evidence for your wife's treaty rights and can skip section 2.4 in the form.

If you are "casually separated" then I would think you are still "married".

Apply now to avoid the ever increasing fees to the BC application!

I was in the same situation when I applied for my BC - I ticked 'married' as you are still married - the HO class seperation without the legallities to still be married.
