Hello. I've been married to an EU citizen and living in the UK since 2001. In 2006, due to a misunderstanding about the requirements for applying for citizenship, I submitted an application. It was turned down based on the fact that I did not have indefinite leave to remain/permanent residence. I immediately submitted an application for Permanent Residence based on my marriage and was successful.
I am now looking to apply for British Citizenship and I am wondering if my Permanent Residence Card is proof that I have passed my Life in the UK Test. I cannot remember my letter, proving that I had passed the test in 2006, being returned to me and I have no copies of it. Would the home office have kept a record of this of should I just resit the test to be on the safe side?

You are mixing terms which makes it difficult to understand your situation.

Have you been granted ILR (which is given if applied under UK immigration rules) or PR (which is given under EEA regulations) ?

Life is the UK is not required for PR under EEA regulations but is required for ILR today. However, I don't think it was required for ILR in 2006.

If you did pass the test in 2006, then there is no need to pass it again. Are you sure you took the Life in the UK test in 2006?

I have a Permanent Residence Card. I received this based on my marriage to a Dutch citizen. Having double checked my document, I see that it was issued in 2007, not 2006 as previously stated.
I did the Life in the UK Test because I was applying for UK Citizenship. My application was turned down because, at the time, I neither had ILR or PR.
I have now had a PR Card for 4 years and would like to apply for BC. I have checked through all the documents that were returned to me from my failed BC application and there is no sign of my Life in the UK Test Pass Letter. Would UKBA have retained this or kept a record of my pass?

I would have taken the Life in the UK Test in either the latter part of 2006 or the early part of 2007. I'm not sure however I know I would have been pushing to submit it before the end of the financial year and changes in fees.

Q 1.22 in form AN is about the test. None of the options really fits your situation. You can explain your circumstances in page 13.

You should not need to resit the test assuming the HO have a record of you taking the test. However as it is almost 5 years back, might be better to play it safe and take it again. The test is not difficult.

Nowadays the HO also gets the test record directly from the test centres. However, no idea how this worked in 2006/2007. It might be that the paper certificate was the only proof if it.

I will redo the test. The test isn't difficult but, to be safe, I'll reread the whole book.... that's the difficult bit.
