British Passport Eligibility Help Required !!!!!!!

Hi All,

Hope you guys can help me in this.

I and my wife are ILR Holders since Jan 2011. Married for almost four years. We both stayed in India for an year from Feb 2011 till Feb 2012. I can apply for my British passport in November as it covers my 90 day absence in the last 12 months.

But when can I apply for my wife's passport. If she applies as my dependent (after I get British Citizenship) the rule says she shouldn't be outside the UK for more than 270 days or 300 max but she is away for more than 400 days in the past 3 years.

I was told that there's a possibility that instead of 3 years dependent she can apply as 4 year dependent so that the days spent outside will increase to 450 which will be in our favour, given the fact I apply after my citizenship and by then she would complete 4 years in UK.

Is this information true and did anyone ever heard or faced a situation similar to this? I spoke to couple of solicitors but they had no idea about this.

Please suggest it would be a great help.

Only BC can apply for a British passport. You are asking about citizenship and not a passport. Your wife can apply by her own merit (not as a BC spouse). In that case, she will need to meet the same requirements you need (5 years, 450 days etc).

Reading the discretion guidelines (section 4), then you are right although this would be application at discretion. Read the guidelines and see if she believes she meets the requirement for a discretion.
