ILR 10yrs residence-break lawful stay??? help!

Hi there,

I am planning to apply for ILR long residence scheme (10 years). I have been reading the quidance etc and I was wondering if it is a break in lawful stay if I got rejected my highly skills migrants application (i was missing 10 points for funds) in 2009. I had to leave within same week and re-enter with a Tier 2 visa as I got a job offer when my application for HSMP was sent. I am under Tier 2 since 2009. Do you think that my ILR would be rejected because of that??

Did you still have leave to remain following the rejection and at the time you left the UK?

No because it took two months to have a reply. I had the appeal option but when I phoned them they said just leave as soon as you can (the earlier the better) and re-enter with an entry clearance (that was my Tier 2). I left within the week. Thank you for your help
