ILR SET(M) for Wife of Pensioner

Post by zeeshanzaheer » Sat Nov 23, 2013 3:25 pm

My uncle is 79 years old and British national. He got 2nd marriage in 2010 after first wife passed away. His wife was granted 2 years leave to remain as spouse .
Now her ILR is due next month. She fulfills all other relevant requirement which are required for ILR.

Only one issue..........my uncle income source is the pension + rent from 2 rooms (900) his monthly income altogether is £1500 .
wife has never worked.

as a retired and pensioner does he need to show any other documents?
will the UKBA treat the ILR application as normal in ordinarily cases or they have different rules for pensioners???
does he need to declare rent income to TAx Office as he never mentioned it?

please advice

The rent-a-room scheme allows you receive up to £4,250 a year up to tax-free. You must complete a tax return if you earn more than the threshold.

For SET(M) your income should suffice so far as any rent/mortgage is not extortionate. However, get any tax issue sorted out if you are declaring it to the UKVI as they do communicate with the HMRC. Even if not declaring it, still you need to pay any tax due.

they are using SET (M).

is there any minimum income requirement for SET (M)???

the husband income is around £560 from pension. plus rent if they declare.

is it enough as they have never claimed any benefits.

also can they show some regular income from family like son/daughter

So long as they have £112.55 per week Net remaining after deducting the mortgage then there shouldn't be an issue.
