Status of dependent when main applicant gets ILR

Post by sjk1 » Tue Dec 31, 2013 6:11 pm

Dear Experts,

I am currently staying in UK with Long term Tier2 ICT and I am planning to apply for ILR in January 2014.

My wife had stayed in UK for 3 years and 9 months in two parts with two separate visas and with a gap of 110 days between two stays. On the first occasion she lived in UK for 1 year and 11 months as my defendant and left UK in Dec 2011. She came to UK in March 2012 with a new dependent visa (as the first one expired) and staying in UK since then.

The UKBA rules say that the dependent need to stay for 2 years before applying for the ILR. Does my wife qualify this criteria? I am in doubt as she had made a fresh entry in March 2012 and has not yet completed 2 years since then.

What will be her immigration status If she does not qualify and I still opt to go for the ILR? Will her tier 2 PBS dependent visa still remain valid or do I need to apply for a different kind of dependent visa along with my ILR application?

Many Thanks
