Tier 1 Dependant ILR - Question on 2 year rule

Post by gprao2010 » Fri Jan 17, 2014 1:51 pm

Hi,

Is the Tier 1 Dependant ILR eligibility rule applicable for the last two years from the date of application? Or Is it enough if its a total of 2 years over the course of dependant's stay in UK?

Example timelines:
Tier 1 Dependant Entry to UK: Jan 11, 2011
Tier 1 Main applicant Eligible to apply for ILR : 21 Aug 2014

Tier 1 Dependant Absences:
1.5 month out of UK in 2012
3 weeks out of UK during first half of 2013
Out of UK from Nov 2013 to May 2014 (7 month absence)

So if I consider the total period of stay from Jan 11, 2011 to Aug 21, 2014 it would be more than 2 years but If I consider only the last 2 years then it would be not. Please advice.

Thanks,

For dependents absence should be limited and for good reason but there is no as such 180 days rule. What was the reason of absence ? e.g. if maternity then you are fine

Thanks for the response dk2011. Yes, the long absence is maternity related.
