Clarification on P60 & Set (O) Form

Post by arindam02 » Mon Mar 03, 2014 4:46 pm

Hello everyone,

I am currently in UK in Tier 1 (General) and will be completing 5 years on the 4th May 2014. I have booked an appointment at PEO on the 12th April, based on 28 days criteria and have got following queries for which I need your help. I'd be grateful if you kindly clarify.

1. Set (O) Form - 7.11. How long have you lived in the UK?

I understand from the Set (O) Guidance note that a person should not apply more than 28 days before completing the qualifying period. Since I am completing the qualifying period on the 4th May 2014, made a booking for ILR application 20 days before i.e. 12th April but getting confused to answer the above question in the Set (O) form. Technically I will not be completing full 5 years on the date of application (i.e. 12th April) but can I mention that I have lived in the UK for 5 years or it has to be 4 years 11 months. Furthermore, please note I was not away more than 180 days in total of 4 years 11 months. Any suggestion would be very helpful.

2. P60 --- I can submit P60 for last 5 years except for the tax year ended 6th April 2014 as I will not have P60 from my employer by 12th April due to short window. Will that result in any problem. However, I have payslips for last 12 months and also a letter from my employer stating my total earnings and tax & NI for last one year can be obtained. Please advise.

Many thanks in advance for your support.
