indefinite leave after 6 years og discretionary leave

Post by MarshaE » Fri Jun 13, 2014 2:25 pm

Just wondering if someone could shed somelight on my situation.

I got married in 2008 and applied for further leave to remain as a spouse but was refused and granted discretionary leave to remain in November 2009

It state I did not get discretionary because of marriage so could apply for idl after it expired but applied for a further 3 years discretionary leave.

I was granted a futher 3 years discretionary leave in September 2013.

What I would like someone to shed some light on is:

No I fall under the new rules or old rules?

Can I apply for idl after I have completed this 3 years.

Also my marriage have broke down will this affect my future application?

I have 2 kids 1 who is 17 and have discretionary leave same as me and one who is British citizen.

My 17 year has been here from he was 4 years old.

Can someone help pleased?

Yes ILR after 6 years DLR. You should be ok so far as you have contact with the children. B1 English and LIUK required for settlement.

So does this means I fall under the old rules?

And the break up of my marriage does not affect me getting idl?

Yes, you'll have transitional protection. You should be ok so far as you have contact with the children.
