ILR Main Applicant and Dependant dates

Hi Experts,

I have few questions regarding my ILR and would appreciate your inputs on this.

1. Need your help in understanding whether 125 days out of country and no UK Salary during that time would cause any problem in applying ILR.

I was working for a company in India and came onsite with Tier 1 General visa first entered UK in Dec 2009 and went back to India in Jan 2011 and continued working offshore till May.

I returned back to UK in May 2011 and started working in a new company and now I am eligible for ILR now.

In this those 120 days between Jan 2011 to May 2011, I was not working for any company in UK and don't have any payslips or

Will there be any problem when I apply for ILR ? about those 120 days absence out of country? Also do we need to take the letter from out of country dates from the employer as it is on annual leave only? My first company is happy to provide letter but it will have my last working date as May 2011. Will this be a problem?

2. And for the dependant my wife first entered UK in May 2011 and went back to India in Nov 2011 for her delivery and I had to go through a renewal my Tier 1 in June 2012 and after that she had to apply for Tier 1 dependant visa for both herself and my daughter in August 2012. Now if I consider her first entry date to UK she is eligible to ILR after 2 years but if they consider her second entry date to UK then it will be after July 2012 which means she needs to be in dependant visa for 5 years. I am confused whether she will get ILR for her along with me or should I wait for 5 years in dependant visa for her?

3. If my wife have to be a dependant for 5 years, Can I apply for ILR for myself and my daughter alone without my wife? Is this possible or allowed?

Also for the dependant to satisfy the english language criteria is the university listed in the points based calculator is enough
or should we need NARIC certificate/medium of instruction letter from university is required?

Appreciate any inputs please.

Pg 22. of the ILR continuous residency period is your ans. Any absences out of the UK when being employed outside of UK breaks residency
