ILR for my Wife

ILR for my Wife

Hello All,

I am a british citizen, having recently acquired citizenship through the ILR route. My wife is in Tier-1 Dependent VISA valid until end of 2015. My query is about settlement/ILR VISA for my wife. Having seen the new rule in UKBA website with regards to the July 9th 2012 cut-off for deciding whether spouse's need to take a 2 year or 5 year route.

My wife's first VISA application (Tier-1 Dependent) was made in Apr 2012, but refused in 3 weeks. A Second appeal was filed in June 2012, but was refused on 30-06-2012. We then filed an appeal and won the appeal, a decision for which was taken in Nov 2012. My wife finally got the VISA stamped in Dec 2012 when she joined me.

I could find this reference in UKBA website:
"Eligibility
You need to have been living in the UK with a ‘partner of a settled person’ visa for:

2 years if you applied for your visa before 9 July 2012
5 years or 10 years if you applied for your visa on or after 9 July 2012
Read the guidance for the 2-year route and the 5- and 10-year routes."


So technically going by what they have stated, my wife's last application was filed before 9 July 2012. But it was refused, later we filed an appeal and decision was overturned. That brings me to my question - So should we be okay to go through the 2 year route ? Any views would be highly appreciated.
