90 Days Concession

Hi,

I am applying ILR under Tier 2 (G) 5 years route.

I wonder is there any rejection on the 90 days concession? I called UKVI and they told me that 90 days concession is on the discretion of caseworker. According to the HO Document, the 90 days "MAY BE" counted toward. I'd like to know if this discretion is normally practised?

Visa Date: 14 Oct 2010
Enter into UK: 7 Nov 2010
Current Visa Expiry: 11 Nov 2016 (after one renewal)

I suppose I am eligible to apply on either 16 or 17 Sept 2015 since I can apply 28 days before the qualifying period.
