10 Long residence ILR advice

Please help me with the following questions for my partner.

1. She is currently on Tier 1 Entre and this visa will expire in July 2017
2. She will be 10 year exactly in UK on the 05 April 2016 and will be applying for ILR
3. First question is that we are currently running business from home and has over 60 clients and employed one person working for us doing data entry job. As we don't really need office to run our business as client does not come to us often. Do we really need to get office in case they ask her at the premium service

4. other question is the can she apply 28 days before she reach 10 years in UK through premium services. One lawyer told us that 28 days grace only apply to postal application

5. Does he also need to bring with her evidence of business activities to premium centre.

1. No one can tell you what the caseworker will ask you. No one here is a clairvoyant! Some never get asked anything by a caseworker at a PEO, while some get grilled for no reason. That you meet the requirements of the leave you currently hold is something everyone must strive for, to avoid grilling / delays / further checks / refusal. Is having an office a requirement for the leave your wife holds?

2. Yes. The lawyer is wrong.

3. As I said before, no one here can tell you what the caseworker will want to see. Be prepared fort he worst and hope for the best.


Just make sure that the tax affairs (since employment / self-employment began) are in order. That is something the caseworkers seem to be very interested in verifying these days.

Firstly thank you all for the valuable advice on this forum.

Please does 28 days rules apply to Long residence 10 year ULR Premium service (same day service).
I asked this as my lawyer insisted that 28 days does not applicable to LR long residence

I think he is mistaken (SET(LR) guidance notes > 4. When to apply).
