ILR Extension for Child and Mother - Please help

Post by VJ143 » Mon Oct 05, 2015 11:20 am

Hello All,

I have got few doubts, Appreciate any help / inputs / advice.

I'm on ILR for last two year and applied for Naturalisation in the beginning of September ( hopefully will get it by beginning of Dec if the current trend of the processing timeline continues)

My wife is ILR dependent where her VISA expires in beginning of Jan , our son was born in India this Feb and they have given the same expiry date as mother in his visa.

here is some of my questions.

1) If i get my Naturalisation in Dec, does the VISA category for them change when i apply it in Jan?

2) What Visa category should i apply for my son?

3) My wife broke the 180 day stay rule by few days due to baby being ill before they came back into UK, is there anything we could do to explain it?

4) Say there is no other method for question 3, does the rules differ when you apply being the wife of BC or an ILR holder?

5) The expiry is on 4th Jan, from when we can apply for the extension - Dec 4th ?

Thanks,
VJ

on question 3, Additional factor is that the chennai office delayed issuing VISA for my son, They have stopped processing my son's application, asking us to pay for immigration health surcharge , After we have paid, a few days later there was a notification saying the money has been refunded. then we got the VISA for my son with the expiry date matching my wife.
