Urgent: HO asking about two children

Post by ali31 » Sun May 05, 2019 1:50 am

Hi everyone, I submitted mine and my wife's application for ILR. I was on tier 1 entrepreneur route. Yesterday, I received a letter asking about my two kids. I didn't put them along with my application because it was costing me over £5k+. Both of my kids are UK born and only one of them had a visa and traveled outside of the UK in 2017. Below is the letter I got from HO:

HO is dedicated to protecting the safeguard and interest of children. We therefore would ask that you now confirm the whereabouts of your children and provide a reason why we have not received an application for leave to remain in line with your own.

I read a lot on this forum and some of my friends told me that kids who are born in the UK are not required to apply for ILR application. Can you please help me with what I need to do in this situation? Am I required by law to put in application for my sons? Are there any exemptions? I obviously want to save my money.

Thanks

Dont panic. Its a generic letter. All you have to reply is that you will register your UK born children as British Citizens after you get your ILR. You dont have to apply ILR for UK born children as they are eligible to be registered as British Citizens after you get your ILR. You will be okay.

Hi tier11417,

I'm also in quite similar situation , I'm going to apply ILR for Myself & My wife next week and have not included my son (10months old born in UK) , to save money.

Do you recommend to include in my Cover letter, the reason for not including my son in our ILR application ?.. Do avoid receiving similar type of generic letter to me also ...!!!

Please advice,

Thanks

Its best to include a cover letter. Does no harm. It might save you time. But I have seen a few members who even sent a cover letter were also sent this generic letter but as soon as they replied to the email their visa was processed. But including a cover letter is the best thing to do.
Its not about saving money. Your UK born does NOT need ILR anyways. Register him as BC after your ILR. That is the correct way to do it.
