ILR (M) Category B

Post by shukri » Fri Aug 30, 2019 5:16 pm

Hi,

When applying for the ILR through the spouse (5 year) route, I understand that there are 2 parts for Category B of the financial requirement:
1) The current employment is at least £18,600
2) Earned £18,600 in the last 12 months

I'm trying to weigh my options in terms of whether switching jobs will impact the visa.

Take the following case (hypothetical), I have been in the employment for less than 6 months. However within this employment, my annual salary is £60,000 so I meet requirement 1.
I have earned £25,000 within this employment.

My questions are:
a) I meet requirement 2 right?
b) Do I need to show payslips and bank statements for the whole 12 months, even though I have earned £25,000 in the last 5 months?
c) If the 12 months are from the date of application, how can I get the latest bank statement and payslip? E.g. I apply 20th Sep, so the latest bank statement and payslip will be of Aug, even though the 12 months start from 20th Sep and backwards?

Thank you very much :)

Category B calculations are based on the last 12 months so you must submit up to 12 months worth of payslips. The final payslip must be within 28 days of the application date

That doesn't seem right? If a person only worked 8 months in the 12 months, then they can't have 12 payslips.

In the last 12 months for any period of employment, you must have made the min salary required and the rules require you to provide payslips covering all those periods. So if you worked for 8 months you must provide 8 payslips, if you worked 11 months 11 payslips and so on.
Payslips covering:
any period of salaried employment in the period of 12 months prior to the date of
application
if the person has been employed by their current employer for less than 6
months
