ILR 28 days rule

ILR 28 days rule

Hi,

Can any one clarify the ILR 28 day rule?

Situation is, Current visa expires 5 months after, 5 year completion

So the 28 day application eligibility is

a)28 days prior to 5 year stay completion?
or
b) 28 days prior to visa expiry?

It is a). No sooner than within 28 days before the 5th anniversary of the date if entry to the UK on a spouse visa.

little confused after seeing this link

it says 28 days is ,28 days counted backwards to the visa issue date..not the entry date? Or I am reading it wrong?
I assume the rule is same for all category.(This one talk about Tier 1 only)

Visa issue date only applies to the points based system visas (tier 1 and tier 2) and not spouse settlement visas. It is not the same for all visa categories.

It is usually useful to read about your own visa category only, different visas have different rules.
