Hello All,
I got my British Citizenship though this route
HSMP ---> Tier 1 General ---> Settlement ---> Citizenship.
Got married and brought my wife from India on PBS dependant (when I was on Tier 1).
Now she is eligible for ILR 5 year route.
Child is British Citizen already.
Since I became Citizen I have been claiming HB. When I applied for wife's last extension, Confirmed with council that only I am getting HB and not my wife and they said yes and we got the extension.
Now before applying ILR for my wife, I noticed that they are paying me
quoting HB statements
"How much the law says we need to live on
For you (and your partner where applicable) £114.85"
After doing some research on internet, I am not sure if they are using couple allowance of £114.85 and not of single parent which should be less. I have spoken to them and they said that is the right amount.
Though I still get LHA of £160 for a couple and a child for a 2 bedroom property.
My Question is
1. Will Home Office look for that £114.85 figure or the LHA (which is not getting affected because LHA is not increased because of my wife)???
2. Should I cancel the HB before applying ILR and offer to repay any overpayment to them as I am not really dependent on it?? will this be a good idea.?
Ask me for more information if needed.Read many guidances and documents and there are so many conflicting descriptions.
