ILR Eligibility Check for Tier 2 Dependant

Hello,

My wife entered UK during Sep 2013 as Tier 2 (G) Dependant, Main applicant on ILR since 2016

Holidays/maternity break:-
· 2015 – April (30 Days), Sep (30 Days) –. Holidays

· 2016/17 - From Jan 2016 till Oct 2017 (Maternity break for almost 20 months)

· 2018/19 – Dec 18 till March 2019 (Holiday)

Is she eligible to apply for ILR now? Her current visa is running out in Dec 2021

Also child first entry to UK on October 2017, I understand child needs follows same as mother visa category.

I intend to apply for the partner’s first, once approved then apply for the child ILR

Please can anyone advise if she is eligible to apply for ILR or should we need to extend for another 3 year Tier 2 G Dependant category.

If she has always held PBS dependant visa since 2013, she has been eligible for ILR since Sep 2018 :!:
Child can get ILR with her

Thanks. Due to unpredictable travel plans last year we thought to delay applying for ILR, also wasn’t sure for her absences. But anyways thanks for the confirmation

Can the child apply separately once mother’s ILR approval?
