Calculating 5 years period

Post by Joship » Wed Feb 19, 2020 11:03 am

Hi,

I would like to check the eligibility (5 years) for my husband to apply for ILR. He is dependent on me (British citizen).

His first visa date - 21/04/2015 ( spouse visa issued in india)
Arrival to UK - 8/5/2015
Visa extended - 28/12/2017 (valid until 26-07-2020)

So, for ILR does my husband has to wait until 28 days before 26-07-2020 (when is current spouse visa expires) or can he apply within 28 days of his first spouse visa issued i.e. any time in April 2020 ( as his 5 yrs finishes on 21/04/2020). Grateful for your help.

I believe his 5 years will end on 8/5/2020 (based on date of entry), so he can apply no earlier than 28 days before that.
