Employment Gap (tier 2 to ILR)

Post by MACHD » Thu Apr 30, 2020 10:13 am

Hello,
I came to U.K. on tier 2 visa in feb 2015 and unfortunately my employer told me that my mentor had resigned so I need to wait till sept they find me next mentor to do my VTe. Anyways after 4 months they asked me to find another job as they can’t provide me mentor to start job under her supervision. It took almost a year and I found my next sponsor in march 2016 and filed my Second tier 2 visa In July 2016. In a nutshell, I have no employment record for this time, started from feb 2015 to July 2016.
I was not curtailed for this period of time as I didn’t receive any letter from the home office.
I had further two extension of tier 2, which is from July 2016 to Oct 2017 and the last one was, Oct 2017 to 2020. I’m full filling all the other requirements for tier 2 to ILR except these below mentioned Question, which are the followings:

“ is my continuity of employment remains valid Or broken due to a gap (feb 2015- July 2016)” ?

In my first tier 2 visa time period ( feb 2015 to July 2016), I have no work/ financial/ tax history, so will it effect my ILR application.

Shall I apply now or wait till the end of my visa in Oct 2020.

I have no p45 for any employment but I do have P60 for the last two years.

Thanking you all in anticipation.

Thanks for replying.
That means the continuity of employment remains valid. Do I have to put forward P45 or P65, while applying for my ILR.
Absence from Uk: Do I need to get it from all previous employers.
Shall I apply now or wait till the end of visa, does it effect your chances of successful visa. (Myths)
Would a simple covering letter would be helpful for the missing employment period or should I seek assistance from immigration lawyer.
Is it still the requirement to meet the minimum salary threshold in this unprecedented situation which is above 36000£.
Many thanks

There is no need to submit P45s or any other similar evidence. You do not need a lawyer. You do not need a cover letter for this. You can apply within 28 days of completing your 5 years. Your visa expiry is irrelevant. You are still expected to meet all the requirements including the min salary. :!:
