SET M - 6 months or 12 months query

Hi Team ,

I just need a clarification to choose which category i should apply. I'm applying for my son and wife ILR under 5 year FLR M Category however I just need an advise with regards to my payment shall i use 6 months category or 12 months .

Firstly Am i still eligible to apply under 6 months rule.

I have been working for a company since May 2020 and i'm still with them however i get weekly wages ,
I was preparing my application under the 6 months category in this 6 months i had 2 bank holiday due to this i got only 4 days pay not full 5 days pay. And in August my son hospitalised due to this i took 1 week emergency unpaid leave and in November 2020 i book 3 days holidays however the company didn't pay me as i'm a contractor so i only got 2 days holidays, my question here is am i still eligible for 6 months category please ?

Secondly if i can't so i have also done the preparation for 12 months as well.

I'm calculating one year in this format from Dec 2019 till Nov 2020

From Dec 2019 - Feb 2020 i worked permanent job and In March 2020 i started a contracting role and i got a Network support engineer role but field based i worked 2 days then due to lockdown in March 2020 that contract postponed to October 2020 and finally Company decided to not to do this migration.

Simultaneously i interviewed for another company and they gave me work from home job from May and this is still continue.

My 12 months period pay.

From Dec 2019 - Feb 2020 i worked permanent job and i got £5512
May 2020 - Cont - I have done contracting with an umbrella company i earned £12,600 but not a regular payment as mention earlier.
I did 1.5 days contract in February and earn £260 from there
Any my wife also working part time so her payment altogether for 6 months £4500 so me and my wife payment if i include all this payments it's coming upto approximately = £23,000

Which category should i apply please.

Your quick response would be much appreciated.

For benefiting as a salaried person you should be working as a subcontractor under CIS scheme administered by HMRC where your tax & national insurance contributions are directly paid to HMRC.
