Query in regards to my child born in uk while my naturalisation was on teh way

Post by avinashatharv » Sat Jan 30, 2021 9:33 pm

Good morning,

Hope you are doing well.

I need some advise and assistance in regards with the category of visa type.

My second child is born in India on August 2020 while both parents have Indefinite Leave to Remain.
After which myself (father) came back to UK in November 2020 and attained mybritish Naturalization through settlement on 11 Dec 2020.
Recieved my british passport successfully processed by 30 Dec 2020.
Currently my second born son who is going to be 6 months old has got his Indian passport.
My wife ([[personal name deleted by moderator]]) is in India with both my kids.
Eldest child is daughter - British citizen born in Plymouth.
Second child is son - born in India and currently holding an Indian passport.

Financial apsect- my last working day was end march 2020.
Been on furlough for almost 3 months
Until end of august - where I was made redundant and had been without a job since september 2020 till 04 Jan 2021.

Currently working for xxxxxxxx as a physiotherapist with telephonic assessment. Contracted for 29 hours per week at 27gbphour.for the next 6 months through my limited company registered in uk.

I am Also looking for extra part time work to attain my full time work but ddue to covid.. The market is still dry and challenging.

Need advise in regrads to the visa requirements for my second child born son that I can bring back my family to join me in UK.

My understanding is Mn1 - but it does take along duration to process outside uk and due to covid ( process expected for at least 6months or more)
Recommended was ILR dependant which is VAF4 appendix 1 was explore dwhich has a process for 12 weeks but could be early - After which I can register the child in uk as British national and further can apply for British passports for both mom and son.

Called citizens advice Bureau in Caerphilly, wales, they informed that my child is eligible for British Citizenship.

Have been receiving contradictory information from various sources ..henceforth has me confused.
If possible need some assistance in the correct form online form filling to fulfill the same.

Kindly do the needful

Many thanks

First of all, do NOT include ANY personal information like a phone number in your posts. Scammers and spammers regularly visit here :!:

Your child was born outside the UK and as you (the parents) were not British, your son has no automatic entitlement to British citizenship. Your child however can be registered as British using form MN1 but the grant of citizenship that way is purely discretionary and has some conditions. One parent must be British, the other parent must be at least settled and the child must hold ILR. He meets all those conditions apart from the fact that he does not have ILR.

So apply from online for a family visa.
Non-British child of a parent, parents or relative who are British citizens or settled in the UK

He should be granted Indefinite Leave To Enter (ILE) to the UK. When in the UK, apply using form MN1 to register him as British.
