ILR for Dependant

Post by sandeepmaturi » Mon Mar 01, 2021 12:04 pm

Hi Team,

I have ILR and my wife completed 4 years and she is eligible to apply in Feb -22 in the UK and now she is planning to go india for 8 months. I understand she should not be out of UK for more that 6 months.

If she is more that 6 months does her clock reset and does she need to stay again 5 year to get her ILR or how does this work.

How is the 5 year stay calculated from the date of entry or every year like Jan to Dec

Thank,
Sandeep

She cannot have more than 180 days in any 12 months period within the 5 years. This means she has to come back and continue her residence for several years again. The long period of absence (while holding a valid visa) can be used to form the beginning of her continuous period then but she still may need at least another 4+ years to get ILR after she returns.
