Can I apply for ILR?

Post by sol4real » Tue Oct 26, 2021 7:34 pm

I was reading about ILR and came across this on the government website

"Time you’ve spent in the UK
You must have been living in the UK on your family visa as a parent for at least:

5 continuous years if you’re on the 5 year route
10 continuous years if you’re on the 10 year route
If you’re not sure which route you’re on, check the letter you got from the Home Office when your ‘leave to remain’ was last approved.

You cannot include time you’ve spent in the UK on any other visa. If you’re on the 10 year route, you can include time you’ve spent on both the 5 year route and the 10 year route to count towards your continuous residence.

I have spent 2.5 years previously on the 10 year route under the parent route and moved to the 5 years route when I renewed, would I be able to apply for ILR when my next renewal comes up ? As I would have spent 5 continuous years on the parent route, 2.5 from the 10 years and 2.5 from the 5 years

You can not use the 2.5 years on 10 years route and lump it with 2.5 years on 5 years route. You will need stretch of the 2 X 2.5 years to then apply for ILR

That was my understanding until i read this part on the government website

it did say you can include time you have spent on BOTH the 5 year route and the 10 year route, wanted to know, if there has been a rule change or maybe i just did not understand the wording

Noted it is not under LR, my earlier response my held opinion.
